درخواست تصویب کنوانسیون در سازمان ملل متحد با عنوان «مصونیت پژوهشگران از اتهامات سیاسی و امنیتی به علت انجام عمل پژوهش

با عرض سلام و احترام، اینجانبان، امضاکنندگان ذیل این کمپین جمع آوری امضای اینترنتی، از محضر شما و اعضای مجمع عمومی سازمان ملل متحد و یا نهادهای سازمانی مرتبط به این موضوع، درخواست داریم که کنوانسیونی لازم الاجرا ، تحت عنوان «مصونیت پژوهشگران از اتهامات سیاسی و امنیتی به علت انجام عمل پژوهشی»، در آن سازمان به رأی‌گیری گذارده و در صورت تصویب، اجرا شود. این طرح به نفع و یا ضرر هیچ کشوری طراحی نشده و هدف از آن حمایت از علم به نفع جامعه بشری است. در این راستا پژوهشگرانی که دخیل در امور ذیل هستند در هر کشور عضو در حیطه انجام پژوهش خود دارای مصونیت قضائی خواهند بود:

1.      پژوهشگرانی که مشغول انجام یک پژوهش قانونی و متعارف هستند.

2.      پژوهشگرانی که موضوع پژوهش خود را به نحوی از انحاء به دولت‌ها و یا ارکان زیرمجموعه آنها اعلام کرده‌ و مخالفتی از سوی آنها دریافت نکرده‌اند.

3.      اگر ماهیت انجام پژوهش منجر به پیدایش جرم سیاسی و یا امنیتی در کشوری شود، دولت مربوطه فقط مجاز به اخطار و یا اعلام توقف پژوهش به مجری آن است و از آن جهت که قبلاً مخالفتی با آن اعلام نداشته، حق بازداشت و یا محاکمه پژوهشگر را به صرف انجام امور پژوهشی که منجر به پیدایش جرم سیاسی و یا امنیتی شده، ندارد.

4.      پژوهش برون دینی پیرامون مرام‌ها، مسلک‌ها، ادیان، فرق، مذاهب و نحله‌های دینی و اعتقادی نباید به منزله تبلیغ تصور شده و از آنها جلوگیری شود.

5.      مصونیت پژوهشگر شامل اتهامات سیاسی و امنیتی به علت انجام عمل پژوهش قانونی و متعارف است.

6.      پژوهشگر در اینجا به معنی عضو و یا فارغ التحصیل از جامعه و یا نهادی دانشگاهی، آموزشی، تحقیقاتی، و یا هر شخص با سابقه پژوهش، آموزش و تحقیق منتشر شده/ثبت شده است.

Dear Mr. Antonio Guterres,

Hereby, we, the signatories of this online signature campaign, request from you and the members of the United Nations General Assembly or related organizations that a binding convention, entitled "Researcher’s inviolability from political and security charges due to the conduct of research" be enacted, put to a vote and, if approved, to be implemented by all members. This plan is not designed for the benefit or harm of any country and its purpose is to support science for the benefit of human society. In this regard, researchers involved in the following matters will have judicial inviolability in each member country in the field of their research project.

1.      Researchers who are engaged in a legal and conventional research.

2.      Researchers who have in some way declared their research to governments or their subsidiaries and have not received any disagreement.

3.      If the nature of the research leads to the emergence of a political or security crime/charge/accusation in a country, the relevant government is only allowed to warn or announce the cessation of the research to the perpetrator and because it has not previously stated any disagreement, has not any right to detain or prosecute the researcher just because of his/her research acts.

4.      Non-religious researches about ideologies, theologies, religious trends, sects, religions rituals and beliefs should not be considered as propaganda/promotion and should not be prevented by any government or group.

5.      The researcher's inviolability includes political and security charges/accusations for conducting a legal and conventional research.

6.      “Researcher” term here means a member or graduate of a scientific community or academic, educational, research institution, or any person with a background of education or published/registered research.
